In order to benefit from the reduced time-limit referred to above, in addition to the box(es) to be ticked above, please explain in a clear and comprehensive manner why the award of the contract without prior publication of a contract notice in the Official Journal of the European Union is lawful, by stating in any case the relevant facts and, as appropriate, the conclusions of law in accordance with the Articles in Directive 2004/18/EC (500 words maximum).
Article 7 of Directive 2004/18/EC states that the Directive shall apply to non-excluded public contracts which have an estimated value of equal to or greater than the specified thresholds. The current threshold applicable to services is 156442 GBP. The contract which is the subject of this Voluntary Ex Ante Transparency Ntoice will not exceed 150000GBP and may be a lower value due to organisational changes.

Even if the Directive applied to this contract due to the value, which it does not, a contracting authority may use the negotiated procedure without the prior publication of a contract notice when, for technical or artistic reasons, the contract may be awarded only to a particular supplier. (Public Contracts Regulations 2006 (as amended) regulation 14(1)(a)(iii)). In this case, the solution is technically unique in that it is a fixed price proprietary application that can be transferred, in its entirety, to the organisation, is remote-hosted and brings no additional burden to the information communication technology infrastructure, and scripting is provided in line with best practice.
